1. Terms & Conditions

1.1 Scope of Services

Rose City Drone Services LLC provides aerial photography, videography, editing, and related media services. Services and deliverables are described in the service order, invoice, or membership summary provided to the client.

1.2 Booking, Deposit & Payment
  • A booking is confirmed once the client signs the service order, unless a different arrangement is documented.
     

  • The remaining balance is due on delivery of final files, or on the day of service if specified on the invoice.
     

  • Payment methods accepted: card, cash, check, Google & Apple Pay, PayPal. Late payments may incur interest of 15% per week.

1.3 Cancellations & Rescheduling
  • Client cancellations made over 3 days before can have their deposit transferrable to a rescheduled date within 90 days or refundable minus a $25 if expressly chosen. (See Refund Policy for details.)

  • Cancellations within 3 days due to client fault may result in forfeiture of deposit and additional fees.
     

  • We may reschedule due to weather, airspace restrictions, or safety concerns. If we cancel, you will be offered a full refund, reschedule, or credit.
     

1.4 Client Responsibilities & Access
  • Clients must provide safe access to property, identify hazards, and secure any required permissions for filming on private property.
     

  • For flights near people, structures, or third-party property, the client is responsible for obtaining third-party consents when required.
     

  • Clients must disclose any applicable local regulations, HOA rules, or venue restrictions before the shoot.
     

1.5 Permits, Airspace & Lawful Operations
  • We operate in compliance with FAA Part 107 aviation laws and regulations . Clients shall not request illegal or unsafe flights. The client is responsible for permissions beyond our standard authorization (e.g., municipal permits, restricted airspace waivers) unless otherwise agreed.
     

1.6 Delivery, Revisions & Turnaround
  • Standard deliverable timeframe: 7–14 business days after the shoot, unless otherwise stated.
     

  • One round of minor revisions is included for editing packages. Major changes beyond the agreed scope may be billed hourly.

1.7 Intellectual Property & Usage Rights
  • Unless an exclusive license is purchased, we retain copyright to all materials we create.
     

  • Upon final payment, the client receives a non-exclusive, perpetual license to use the delivered photos/videos for the purposes outlined in the service order. Redistribution, resale, or sublicensing beyond the permitted uses without explicit written permission or a separate license is copyright infringement and  will result in appropriate legal action.
     

  • We may use delivered media for portfolio, promotional, and social media purposes unless Client requests in writing that we not do so prior to booking.
     

1.8 Confidentiality
  • We will not disclose the client’s confidential business information except as required by law. The client consents to normal promotional use of final media (see above) unless a written NDA is executed.
     

1.9 Liability Limitation & Indemnity
  • To the fullest extent permitted by law, our liability for any claim related to the services shall not exceed the amount actually paid by the client for the specific service giving rise to the claim.
     

  • Client agrees to indemnify and hold us harmless from claims arising from the client’s breach of these terms or from the client's actions.

1.10 Insurance
  • We maintain general liability insurance and drone liability insurance. Policy limits and details are available upon request.
     

1.11 Termination
  • Either party may terminate for material breach if a breach is not cured within 14 days’ notice. Fees incurred to date remain due.
     

1.12 Governing Law & Disputes
  • These terms are governed by the laws of Georgia. Disputes will be resolved in the appropriate courts of Thomas County or by binding arbitration, per the parties' agreement.
     

1.13 Modifications
  • We may update these terms from time to time; changes will be effective on posting. Major changes will be communicated to active clients.
     

 

2. Privacy Policy

2.1 What We Collect
  • Personal data: name, email, phone, billing address, job title (if provided).
     

  • Service data: booking details, location(s) of shoots, property ownership information when provided.
     

  • Media files: photos and video you supply or that we capture.
     

  • Usage data: cookies and analytics on our website.
     

2.2 How We Use It
  • To provide and manage services, scheduling, billing, and customer service.
     

  • To edit, deliver, and store media deliverables.
     

  • For marketing (with your consent) and to improve services.

2.3 Sharing & Third Parties
  • We may share data with: payment processors, cloud storage providers, contracted editors, and legal authorities when required.
     

  • We do not sell personal data.

2.4 Security & Retention
  • We use reasonable administrative, technical and physical safeguards. No system is perfect, residual risk exists.
     

  • We retain media and client records for 1 year after project completion unless otherwise agreed or legal retention obligations require longer storage.

2.5 Client Rights
  • You may request access, correction, deletion, or portability of personal data, and opt out of marketing communications.

2.6 International Transfers
  • Data may be stored in cloud services that transfer data internationally. By using our services you consent to such transfers.

3. Refund & Cancellation Policy

​

3.1 Deposits
  • Deposits are non-refundable except where we cancel the booking due to our scheduling error or inability to perform.

 

3.2 Client Cancellation
  • Cancellations made before 3 days before planned service: deposit transferrable to a rescheduled date within 90 days or refundable minus a $25 if expressly chosen.
     

  • Cancellations within 3 days before: deposit forfeited; remainder refunded if pre-paid beyond deposit.
     

  • Cancellations within 1 day: no refund; client is liable for balance due.
     

3.3 Provider Cancellation
  • If we must cancel, clients will be offered: (a) reschedule at no extra charge, (b) full refund, or (c) credit toward future services.
     

3.4 Weather & Force 
  • If weather or other conditions make safe operation impossible, we will reschedule; refunds only provided if rescheduling is not possible and we cancel the job.
     

3.5 Membership Refunds
  • Membership monthly charges are billed in advance and are non-refundable for past billing periods. See Membership Agreement below for cancellation windows and prorating policy.
     

 

4. Membership / Subscription Agreement

4.1 Enrollment & Billing
  • Memberships are recurring and billed monthly on the subscription date.
     

  • Membership benefits begin upon successful payment and remain active while the account is in good standing.
     

4.2 Benefits & Deliverables
  • “Free” monthly services are subject to scheduling availability and standard usage limits. Unused benefits in a month do not automatically roll over unless explicitly stated.
     

4.3 Cancellation & Termination
  • Members may cancel at any time. Cancellation takes effect at the end of the current billing cycle. No prorated refunds for partial months unless required by law.
     

  • We may terminate membership for violation of terms, fraud, or non-payment.
     

4.4 Changes to Membership
  • We may change membership pricing or benefits with 30 days’ notice to current members; you may cancel if you do not accept the change.

5. Media Release & Licensing

5.1 Client Usage
  • After full payment, the client receives a non-exclusive license to use media for the purposes specified in the service order.
     

  • Clients must not remove embedded metadata or credits without permission or a license allowing them to do so. Resale, redistribution, or sublicensing stolen content in any shape or form is copyright infringement and will result in appropriate legal action.

5.2 Exclusive Use & Archival
  • Exclusive-use licenses and extended archival storage are available for additional fees.

6. Safety & FAA Compliance

​

  • All flights are conducted by trained operators in compliance with FAA Part 107, local laws, and safe operating practices.
     

  • Clients must inform us of sensitive locations (medical facilities, prisons, schools with restrictions).
     

  • We will refuse flights that present an unreasonable risk to people, property, or public welfare.

7. Data Use, Accuracy & Expectations

7.1 Data Collection & Purpose

Rose City Drone Services LLC collects and processes data only for legitimate business purposes, including service delivery, client communication, invoicing, project management, marketing, and improvement of services. Data may include images, videos, mapping data, coordinates, site addresses, and client-provided information necessary to perform contracted services.

All collected data is used exclusively to:

  • Fulfill service agreements or memberships;

  • Communicate quotes, invoices, or project details;

  • Provide accurate deliverables and customer support;

  • Enhance service quality and operational safety;

  • Maintain records for legal or compliance purposes.

7.2 Ownership & Use of Media

Unless otherwise specified in writing, Rose City Drone Services LLC retains the right to store, process, and use non-confidential project data and imagery for portfolio, marketing, or analytical purposes. Client-sensitive or proprietary data will not be shared publicly without explicit written consent.

7.3 Accuracy of Information

While Rose City Drone Services LLC strives for the highest level of precision in aerial data, mapping, and imaging, all deliverables are provided “as-is.” Factors such as environmental conditions, GPS accuracy, airspace restrictions, and data transmission may affect accuracy. Clients should not rely on provided materials as legal, survey-grade, or engineering documentation.

7.4 Client Responsibilities

Clients are responsible for ensuring that all information provided is complete and accurate. Rose City Drone Services LLC is not liable for delays, inaccuracies, or additional costs resulting from incomplete or incorrect client information.

7.5 Data Retention & Deletion

Project data is typically stored for up to 12 months from the delivery date unless a longer retention period is required or agreed upon. Clients may request deletion of non-essential data after project completion, subject to legal and operational obligations.

7.6 Third-Party Tools & Services

Some services may utilize third-party software or cloud platforms. Rose City Drone Services LLC is not responsible for external system failures or data losses resulting from third-party operations, though all reasonable measures will be taken to ensure secure and reliable handling of client data.

7.7 Expectation of Service

Rose City Drone Services LLC aims to maintain professional accuracy, communication, and consistency across all projects. However, certain variables such as weather, equipment malfunction, airspace clearance, or unforeseen site conditions may affect scheduling or deliverables. Clients will be notified promptly if such issues arise, and rescheduling or alternate arrangements will be coordinated in good faith.

7.8 Disclaimer of Guarantee

All imagery, video, and data deliverables are created based on available conditions and tools at the time of service. While every effort is made to ensure quality and accuracy, results may vary by project, and Rose City Drone Services LLC makes no absolute warranty regarding perfection, interpretation, or specific outcomes.

 

8. Acceptance

Rose City Drone Services LLC - Frequently Asked Questions (FAQ)

1. What services do you offer?

We provide aerial photography, videography, photo/video editing, and media solutions for real estate, construction, inspections, and marketing. We also offer monthly membership plans for clients who need regular media coverage.

 

2. How do I book a session?

You can book online, by email, or by phone. Bookings are confirmed once we receive a signed service agreement and a deposit.

 

3. How much is the deposit?

A 25% non-refundable deposit is required to secure your date and time. The remaining balance is due before final delivery of media unless otherwise agreed.

 

4. What if I need to cancel or reschedule?

  • ≥72 hours before flight: You may reschedule or receive a credit.
     

  • <72 hours before flight: Deposit may be forfeited.
     

  • If we must reschedule due to weather, airspace restrictions, or safety concerns, we will work with you to find the earliest available date at no extra charge.

5. What about weather delays?

Safety comes first. If weather conditions prevent safe flying, we will reschedule your session free of charge.
 

6. Are you licensed and insured?

Yes, we are FAA Part 107 certified and carry general liability and drone insurance. Proof of coverage is available upon request.

 

7. How long does it take to get my photos/videos?

Standard turnaround is 7–14 business days for edited media. Rush delivery is available for an additional fee.

 

8. Do I own the photos/videos?

After full payment, you receive a non-exclusive, perpetual license to use the media for the purposes agreed. We retain copyright unless an exclusive buyout is purchased.

 

9. Can I request revisions?

Yes, one round of minor revisions is included. Additional edits or major changes outside the original scope may be billed at an hourly rate.

 

10. Do you fly everywhere?

As of September 2025, we only service Thomas County. Other nearby counties and municipalities will be available later on as business expands and stabilizes.

 

11. What do I need to prepare before the shoot?

  • Ensure the property or site is clean and ready.
     

  • Remove vehicles or objects blocking the view if needed.
     

  • Inform neighbors or staff if flights will be near shared spaces.
     

  • Secure pets and notify us of any hazards (power lines, construction equipment, etc.).
